Short answer
There is no legal marketplace in the United States for a counterfeit Gucci bag. No resale site permits the listing. Selling, shipping, or brokering a fake exposes the seller to federal criminal charges, a civil suit from Kering, and a frozen payment account.
What federal law says
18 U.S.C. § 2320 makes trafficking in goods with a counterfeit mark a federal crime. A first conviction carries up to 10 years in prison. A second conviction carries up to 20 years. Fines run to $250,000 for an individual and $500,000 for a business under 18 U.S.C. § 3571.

The trademark owner can sue in civil court at the same time. Under 15 U.S.C. § 1117(c), statutory damages reach $200,000 for each counterfeit mark used on each type of goods. That figure rises to $2,000,000 per mark when the use is willful. Gucci trademarks sit with Kering, which files suits and reports sellers to customs.
US Customs and Border Protection seizes counterfeit goods under 19 U.S.C. § 1526. The personal-use exemption does not cover counterfeits. A single seized bag can be held and destroyed.
Platform rules
Resale sites ban counterfeit listings in their terms of service. Enforcement works the same way across all of them:
- eBay runs the Verified Rights Owner program. A rights-holder report removes the listing and can suspend the account.
- Poshmark authenticates items above $500. A confirmed counterfeit ends in a permanent ban.
- Mercari, Depop, and Facebook Marketplace remove listings and close accounts on repeat reports.
- The RealReal, Vestiaire Collective, Fashionphile, and Rebag inspect every item on intake. Counterfeits are rejected, then returned or destroyed.
Payment processors add a second layer. Stripe, PayPal, and Square freeze funds tied to counterfeit sales. Holds can run 180 days.
If the bag is real
Authentic Gucci sells on The RealReal, Fashionphile, Rebag, Vestiaire Collective, and eBay. Commission ranges from 15% to 40% of the sale price. Poshmark charges a flat 20% above $15. Authentication by Entrupy or Real Authentication raises the resale price and cuts disputes.
If the bag is counterfeit
There is no legal sale route in the US. Practical options are a return to the original seller, keeping the item, or destroying it. Donation is not a safe path. Passing a counterfeit to a thrift store or a friend can count as trafficking under the same statute. Legal resale value for a fake is zero.
Check before you list
Gucci bags carry an internal serial number and a date code on a leather tag. Since 2016, some models include an NFC chip. Serial numbers repeat across counterfeit batches, so a matching number proves nothing on its own. A paid authentication report is the record that protects a seller on any platform.
