Short answer
A replica Hermès bag is a counterfeit. It copies a Birkin, Kelly, or Constance design and carries a fake Hermès stamp. Making, selling, or importing these bags is illegal in the United States. Buying one for personal use gives no legal cover: U.S. Customs and Border Protection can seize the bag and destroy it with no payment back to the buyer.
How the replica market splits
Sellers group counterfeits into tiers. Price tracks labor and material, not provenance.
- Budget: $50 to $200. PU or split leather, machine stitching, glued edges, plated hardware.
- Mid-tier: $200 to $600. Cowhide or low-grade Togo-style leather. Hardware has closer weight.
- Superfake, sold as 1:1: $800 to $1,500. Full-grain leather, hand-sewn saddle stitch, copied stamps and blind codes.
No tier is authentic. Every tier carries a trademark that belongs to another company.
Retail prices on the real item
Hermès does not sell Birkin or Kelly bags on its website. A Birkin 25 or Kelly 25 in Togo leather lists above $10,000 at retail in 2025. Auction results at Sotheby's and Christie's show hammer prices that run two to four times retail for rare leathers and hardware. That gap is the reason the counterfeit market exists.
Legal status in the US
- Criminal. 18 U.S.C. § 2320 covers trafficking in counterfeit goods. A first offense carries up to 10 years in prison and a $2,000,000 fine for an individual.
- Civil. The Lanham Act, 15 U.S.C. § 1114, lets a brand sue. Statutory damages for willful counterfeiting reach $2,000,000 per counterfeit mark, per type of goods sold.
- Import. CBP seizes trademark-infringing goods under 19 U.S.C. § 1526. The personal-use exemption does not apply to counterfeits.
Reselling a counterfeit bag, even one bought for personal use, becomes trafficking.
How authenticators spot a fake
Paid authentication runs $25 to $75 per bag and takes one to three days. The usual checks are:
- Stitching. Hermès uses a hand saddle stitch with a slight slant. Machine stitches form a flat, even line.
- Stamp. The blind stamp, or foil stamp on newer bags, has a set font and spacing. Replicas drift by 0.5 mm or more.
- Hardware. Engraving depth, rivet shape, and the turnlock mechanism.
- Leather. Grain pattern, pores, and smell. Coated leather has no pores.
- Codes. Date codes and craft stamps are recorded and can be checked against known batches.
Risks that go past the legal question
Sellers in this market operate outside payment protections. Common outcomes include no delivery, a bag that does not match photos, and card data used elsewhere. Leather and dye in seized goods face destruction, not return. CBP reports that counterfeit apparel and leather goods rank among its top seized categories by value.
Scale of the trade
The OECD and EUIPO put counterfeit goods at about $464 billion in 2019, roughly 2.5% of world trade. Clothing and leather goods were the two most counterfeited product categories in that study. Hermès is one of the brands copied most often.
