Short answer

You cannot resell a counterfeit Balenciaga bag in the United States. Selling, offering for sale, or distributing a counterfeit is a federal crime under 18 U.S.C. § 2320. A first offense carries up to 10 years in prison and a $2,000,000 fine for an individual. Repeat offenses carry up to 20 years. Companies face up to $5,000,000.

Marketplaces remove the listings. Payment processors freeze the funds. Buyers who find out can file a chargeback or sue. Resale value on a legitimate secondary market is zero.

Federal law

The Trademark Counterfeiting Act covers trafficking, which includes selling one item to one buyer. A gift or a trade can also count as a transfer.

The Lanham Act, 15 U.S.C. § 1114, adds civil liability. A brand that proves willful counterfeiting can recover statutory damages up to $2,000,000 per counterfeit mark per type of goods. Balenciaga is a registered trademark owned by Kering. Kering enforces it.

  • Criminal penalties: up to 10 years for a first offense, 20 years for a repeat.
  • Fines: $2,000,000 for an individual, $5,000,000 for a company.
  • Civil statutory damages: up to $2,000,000 per mark per goods type.
  • Seizure and destruction of the goods.

Platform rules

Major US resale platforms ban counterfeit listings. eBay, Poshmark, Mercari, Depop, Vinted, The RealReal, and StockX all apply this rule.

StockX and The RealReal authenticate items before sale. Counterfeit bags are rejected and the seller account is flagged. eBay removes listings after a rights-holder report and can suspend the account.

PayPal, Stripe, and Venmo prohibit counterfeit sales in their acceptable use policies. A buyer dispute ends in a refund taken from the seller in most cases, plus a permanent ban.

Import and customs

19 U.S.C. § 1526 lets US Customs and Border Protection seize counterfeit goods at the border. The personal-use exemption that applies to many imports does not cover counterfeits.

CBP seized about 20,000 shipments of counterfeit goods in fiscal 2023. Estimated retail value was near $2.7 billion. Handbags and apparel are among the top seizure categories.

Resale value

Authentic Balenciaga bags hold value. Hourglass, City, and Le Cagole models trade on the secondary market at 40% to 80% of retail, based on condition, color, and receipts.

Replica bags do not. Authentication services reject them, so no platform with buyer protection will list them. Gray-market listings for replicas sell at 10% to 20% of the original purchase price in the best case. Payment is often disputed. The seller carries the legal risk, not the buyer.

What is legal

  • Buying a counterfeit for personal use is not the offense targeted by § 2320 in most US cases. Import is still subject to seizure.
  • Keeping or destroying the bag is the low-risk path.
  • Selling an authentic Balenciaga bag is legal. Keep the receipt and any authentication card.
  • Reselling a counterfeit, in any amount, is not legal.

Red flags for buyers

  • Price 70% or more below retail.
  • No receipt, box, or dust bag.
  • Stock photos instead of the actual item.
  • Seller refuses a third-party authentication check.
  • Payment requested outside the platform.
